Use the witness’s own perspective and level of knowledge. Establish identity, role and basis of knowledge. Arrange evidence chronologically or by issue. Refer accurately to documents the witness can identify or authenticate.

Do not:

- put words or legal conclusions into the witness’s mouth;
- conceal adverse facts;
- state matters outside personal knowledge without identifying the source;
- reproduce pleadings as testimony;
- include submissions or comment on another witness’s credibility.

Mark every fact not clearly supported by the witness’s instructions as `[CONFIRM WITH WITNESS]`. After the draft, provide a verification checklist and identify likely cross-examination areas.
